{"id":3972,"date":"2016-11-03T21:21:54","date_gmt":"2016-11-03T21:21:54","guid":{"rendered":"https:\/\/curell.com\/?p=3972"},"modified":"2022-10-19T21:09:07","modified_gmt":"2022-10-19T21:09:07","slug":"proteccio-de-secrets-comercials","status":"publish","type":"post","link":"https:\/\/curell.com\/ca\/proteccio-de-secrets-comercials\/","title":{"rendered":"Protecci\u00f3 de secrets comercials"},"content":{"rendered":"<div class=\"single-blog-content entry wpex-mt-20 wpex-mb-40 wpex-clr\">\n<p>El Consell de la Uni\u00f3 Europea ha adoptat una nova Directiva (UE) 2016\/943 sobre\u00a0<strong>protecci\u00f3 de secrets comercials<\/strong>.<\/p>\n<p>La Directiva estableix normes per a la protecci\u00f3 dels coneixements t\u00e8cnics (en angl\u00e8s\u00a0<em>know-how<\/em>) no divulgats i la informaci\u00f3 empresarial confidencial, que constitueixen els denominats \u2018secrets comercials\u2019 de les empreses de la UE, adoptant mesures comunes contra la seva obtenci\u00f3, utilitzaci\u00f3 o revelaci\u00f3 il\u00b7l\u00edcita.<\/p>\n<p>Els Estats Membres de la Uni\u00f3 Europea disposen d\u2019un termini de\u00a0<strong>dos anys per procedir a la transposici\u00f3 de la Directiva a la legislaci\u00f3 nacional<\/strong>. Hauran d\u2019establir\u00a0 mesures, procediments i vies de recurs equitatives, eficaces i dissuasives per tal de garantir l\u2019exist\u00e8ncia de reparacions civils contra l\u2019obtenci\u00f3, utilitzaci\u00f3 i divulgaci\u00f3 il\u00b7l\u00edcites de secrets comercials.
