{"id":6433,"date":"2023-03-27T11:30:27","date_gmt":"2023-03-27T11:30:27","guid":{"rendered":"https:\/\/curell.com\/?p=6433"},"modified":"2023-04-03T11:27:23","modified_gmt":"2023-04-03T11:27:23","slug":"digues-me-la-teva-distintivitat-i-et-dire-la-teva-forca","status":"publish","type":"post","link":"https:\/\/curell.com\/ca\/digues-me-la-teva-distintivitat-i-et-dire-la-teva-forca\/","title":{"rendered":"Digues-me la teva distintivitat i et dir\u00e9 la teva for\u00e7a"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">De vegades, quan un client ens encarrega una sol\u00b7licitud de registre de marca, ens presenta un signe que, encara que pot ser molt atractiu en termes de m\u00e0rqueting, gaudeix d&#8217;un car\u00e0cter distintiu feble.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L&#8217;escassa distintivitat d&#8217;aquestes marques es deu, principalment, al fet que s\u00f3n descriptives de la qualitat, la quantitat, les caracter\u00edstiques, el dest\u00ed, el tipus o la dimensi\u00f3 dels productes o serveis que pretenen protegir. Cal distingir entre marques merament descriptives (que no s\u00f3n registrables) o marques de distintivitat feble. Per exemple, una marca merament descriptiva seria \u201cpomes espremudes\u201d per a designar suc de poma i una marca feble seria \u201celixir de pomes\u201d per al referit producte.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Els termes o expressions que es refereixen a les caracter\u00edstiques dels productes i serveis, no s\u00f3n apropiables per una sola persona o empresa i han d&#8217;estar a disposici\u00f3 dels competidors. Per aix\u00f2, les marques que nom\u00e9s consisteixen en aquestes expressions o termes descriptius solen ser rebutjades per les oficines de registre.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Per a aconseguir el registre d&#8217;aquestes marques, cal acompanyar les expressions o termes descriptius amb elements denominatius o gr\u00e0fics addicionals que no tinguin relaci\u00f3 amb les caracter\u00edstiques dels productes i serveis designats i que confereixin a la marca un cert grau de distintivitat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">No obstant aix\u00f2, encara que siguin concedides, aquestes marques dif\u00edcilment s\u00f3n oposables del registre i \u00fas de marques de tercers quan aquestes coincideixen o s\u00f3n similars en els elements febles o no apropiables. Aquest ha estat el cas de la recent sent\u00e8ncia del Tribunal General de la Uni\u00f3 Europea del 18 de gener de 2023, en l&#8217;assumpte T-443\/21, YOGA ALLIANCE INDIA INTERNATIONAL, que ara analitzem.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El 16 d&#8217;abril de 2018, Swami Vidyanand, nacional de l&#8217;\u00cdndia, va presentar davant l&#8217;Oficina Internacional de l&#8217;Organitzaci\u00f3 Mundial de la Propietat Intel\u00b7lectual (OMPI) el registre internacional que designa la Uni\u00f3 Europea \u201cYOGA ALLIANCE INDIA INTERNATIONAL\u201d gr\u00e0fica, per a serveis d&#8217;educaci\u00f3, formaci\u00f3, entrenament i activitats esportives i culturals, segons la reproducci\u00f3 seg\u00fcent:<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-6426 aligncenter\" src=\"https:\/\/curell.com\/wp-content\/uploads\/2023\/03\/Captura-de-Pantalla-2023-03-27-a-les-10.21.22.png\" alt=\"\" width=\"178\" height=\"177\" srcset=\"https:\/\/curell.com\/wp-content\/uploads\/2023\/03\/Captura-de-Pantalla-2023-03-27-a-les-10.21.22.png 178w, https:\/\/curell.com\/wp-content\/uploads\/2023\/03\/Captura-de-Pantalla-2023-03-27-a-les-10.21.22-150x150.png 150w\" sizes=\"auto, (max-width: 178px) 100vw, 178px\" \/><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aquesta sol\u00b7licitud de registre internacional va rebre tres oposicions, una d&#8217;elles per part de l&#8217;empresa nord-americana YAplus d\/b\/a Yoga Alliance sobre la base de l&#8217;exist\u00e8ncia de risc de confusi\u00f3 amb la marca de la Uni\u00f3 Europea anterior \u201cYOGA ALLIANCE\u201d gr\u00e0fica, tamb\u00e9 per a serveis d&#8217;educaci\u00f3 i formaci\u00f3 en ioga, serveis educatius i altres serveis relacionats, reprodu\u00efda a continuaci\u00f3:<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6423 aligncenter\" src=\"https:\/\/curell.com\/wp-content\/uploads\/2023\/03\/Captura-de-Pantalla-2023-03-27-a-les-10.21.32-300x134.png\" alt=\"\" width=\"300\" height=\"134\" srcset=\"https:\/\/curell.com\/wp-content\/uploads\/2023\/03\/Captura-de-Pantalla-2023-03-27-a-les-10.21.32-300x134.png 300w, https:\/\/curell.com\/wp-content\/uploads\/2023\/03\/Captura-de-Pantalla-2023-03-27-a-les-10.21.32.png 340w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/span><\/p>\n<p><span style=\"font-weight: 400;\">El 2 d&#8217;abril de 2020, la Divisi\u00f3 d&#8217;Oposici\u00f3 de l&#8217;Oficina de Propietat Intel\u00b7lectual de la Uni\u00f3 Europea (EUIPO) va estimar l&#8217;oposici\u00f3 al\u00b7legant identitat i similitud entre els serveis, aix\u00ed com similitud entre els signes comparats. La Divisi\u00f3 d&#8217;Oposici\u00f3 va considerar que el car\u00e0cter distintiu de la marca oponent \u00e9s normal malgrat la pres\u00e8ncia de l&#8217;element verbal \u201cYOGA\u201d, el qual es refereix de manera directa als serveis oferts sota la marca oponent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Posteriorment, el titular de la marca impugnada va presentar recurs davant la Sala de Recurs de l\u2019EUIPO, la qual, a la seva resoluci\u00f3 datada del 17 de mar\u00e7 de 2021, va anul\u00b7lar la decisi\u00f3 de la Divisi\u00f3 d\u2019Oposici\u00f3 en considerar que \u201cYOGA ALLIANCE\u201d per designar serveis relacionats amb la pr\u00e0ctica del ioga t\u00e9 un nivell de distintivitat baix. En aquest cas, la Sala de Recurs va considerar que, no nom\u00e9s \u201cYOGA\u201d t\u00e9 un nivell baix de distintivitat, sin\u00f3 que tamb\u00e9 \u201cALLIANCE\u201d fa refer\u00e8ncia a una associaci\u00f3 formada entre entitats per a un benefici com\u00fa. Per la qual cosa, el car\u00e0cter distintiu d\u2019\u201dALLIANCE\u201d tamb\u00e9 \u00e9s baix en no transmetre una informaci\u00f3 espec\u00edfica sobre l&#8217;origen comercial del prove\u00efdor del servei.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La resoluci\u00f3 de la Sala de Recurs de l\u2019EUIPO va ser recorreguda davant el Tribunal General de la Uni\u00f3 Europea per la part oponent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El Tribunal General, a la seva sent\u00e8ncia 18 de gener de 2023, argumenta que els usuaris de ioga s\u00f3n persones generalment obertes i amb una \u201corientaci\u00f3 internacional\u201d, per la qual cosa \u00e9s molt probable que coneguin el significat de la paraula \u201cioga\u201d que \u00e9s un fenomen mundial de gran popularitat. D&#8217;altra banda, el Tribunal argumenta que el vocable \u201cALLIANCE\u201d \u00e9s un terme que s&#8217;utilitza comunament a la Uni\u00f3 Europea, per tant, existeixi o no la seva equival\u00e8ncia en un determinat idioma europeu, el seu significat ser\u00e0 identificat pel consumidor mitj\u00e0 de la Uni\u00f3 Europea.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La sent\u00e8ncia considera que el p\u00fablic de la Uni\u00f3 Europea comprendr\u00e0 el significat dels vocables \u201cYOGA\u201d i \u201cALLIANCE\u201d, tots dos amb un car\u00e0cter distintiu molt esc\u00e0s o nul.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Respecte al gr\u00e0fic que conforma la marca anterior, aquest consisteix en un element en forma de flor de lotus que domina el signe juntament amb els elements verbals. El Tribunal General confirma la resoluci\u00f3 de la Sala de Recurs en el sentit que, en ser la flor de lotus un s\u00edmbol molt conegut en el sector del ioga, t\u00e9 un cert car\u00e0cter al\u00b7lusiu dels serveis protegits.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En relaci\u00f3 amb la marca sol\u00b7licitada, el Tribunal General tamb\u00e9 confirma les conclusions de la Sala de Recurs, conforme els elements coincidents \u201cYOGA ALLIANCE\u201d s\u00f3n descriptius. La resta d\u2019elements que conformen la marca sol\u00b7licitada, d&#8217;acord amb la sent\u00e8ncia, tamb\u00e9 gaudeixen d&#8217;un car\u00e0cter distintiu feble atesa la seva c\u00e0rrega al\u00b7lusiva. En aquest sentit, la sent\u00e8ncia ent\u00e9n que el gr\u00e0fic en forma de globus es limita a refor\u00e7ar el concepte de l\u2019element denominatiu \u201cinternacional\u201d situat en la part inferior de la marca, que el gr\u00e0fic en forma de corona \u00e9s un element decoratiu t\u00edpic que representa un triomf o \u00e8xit, i que el terme \u201c\u00cdNDIA\u201d es refereix simplement a la situaci\u00f3 geogr\u00e0fica on el prove\u00efdor del servei est\u00e0 establert.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La sent\u00e8ncia conclou que, encara que els signes presenten similituds en l&#8217;aspecte fon\u00e8tic i en l&#8217;aspecte conceptual, aquestes similituds es basen en elements denominatius desprove\u00efts de car\u00e0cter distintiu, per la qual cosa les difer\u00e8ncies visuals o gr\u00e0fiques tenen un major impacte en la valoraci\u00f3 del risc de confusi\u00f3. Per tant, el Tribunal General, en valorar els signes en el seu conjunt, estima la no exist\u00e8ncia d&#8217;un risc de confusi\u00f3 entre les marques, malgrat que els serveis s\u00f3n similars i id\u00e8ntics.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ara b\u00e9, ens preguntem quin hauria estat el resultat de la sent\u00e8ncia si la marca oponent hagu\u00e9s consistit nom\u00e9s en l&#8217;element verbal \u201cYOGA ALLIANCE\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cal considerar que existeixen marques registrades davant l\u2019EUIPO amb l&#8217;element \u201cALLIANCE\u201d i sense cap altre element figuratiu addicional, com per exemple \u201cTHE COMPETENCY ALLIANCE\u201d, \u201cWE CARE ALLIANCE\u201d, \u201cCHAIN OF ALLIANCE\u201d, \u201cGLOBAL INTELLECTUAL PROPERTY ALLIANCE\u201d, \u201cDEVELPOMENT AND CLIMATE ALLIANCE\u201d o fins i tot \u201cALLIANCE\u201d de forma a\u00efllada per a designar serveis de subministrament d&#8217;informaci\u00f3 de recerca m\u00e8dica i cient\u00edfica.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Doncs b\u00e9, observem que la sent\u00e8ncia comentada no sempre coincideix amb el criteri del Tribunal General, ja que en la seva recent sent\u00e8ncia d&#8217;1 de mar\u00e7 de 2023, en l&#8217;assumpte T-25\/22, HE&amp;ME, va estimar l&#8217;exist\u00e8ncia d&#8217;un risc de confusi\u00f3 entre la marca\u00a0 sol\u00b7licitada <img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-6430\" src=\"https:\/\/curell.com\/wp-content\/uploads\/2023\/03\/Captura-de-Pantalla-2023-03-27-a-les-10.57.13.png\" alt=\"\" width=\"150\" height=\"50\" \/> <\/span><span style=\"font-weight: 400;\">per a distingir peces de vestir i la marca anterior \u201cME\u201d denominativa, marca anterior registrada lal Benelux tamb\u00e9 per a peces de vestir.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En aquest cas, el Tribunal va considerar que \u201cHE\u201d \u00e9s descriptiu dels productes, ja que identifica el p\u00fablic al qual els productes van destinats, concretament, el p\u00fablic mascul\u00ed. Mentre que l&#8217;element coincident \u201cME\u201d es refereix a la persona que compra els productes, per la qual cosa no es pot estimar que sigui un element totalment descriptiu dels productes en q\u00fcesti\u00f3.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Amb tot, i no sense despertar uns certs dubtes, el Tribunal estima que existeix un risc de confusi\u00f3 entre \u201cHE&amp;ME\u201d i \u201cME\u201d, en estar totalment inclosa la marca oponent \u201cME\u201d dins la marca sol\u00b7licitada i en ser els productes coincidents.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aquest \u00faltim cas ens convida a pensar que, si la marca oponent \u201cYOGA ALLIANCE\u201d hagu\u00e9s estat una marca denominativa, sense cap element figuratiu, hi hauria la possibilitat que el Tribunal hagu\u00e9s estimat l&#8217;exist\u00e8ncia d&#8217;un risc de confusi\u00f3 amb la marca sol\u00b7licitada \u201cYOGA ALLIANCE INDIA INTERNATIONAL\u201d gr\u00e0fica. No obstant aix\u00f2, cada cas ha de ser valorat en funci\u00f3 de les seves pr\u00f2pies caracter\u00edstiques.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En definitiva, la conclusi\u00f3 general \u00e9s que com m\u00e9s fantasiosa \u00e9s una marca, i com m\u00e9s s&#8217;allunyi de qualsevol al\u00b7lusi\u00f3 a les caracter\u00edstiques dels productes i serveis designats, la protecci\u00f3 atorgada ser\u00e0 m\u00e9s gran i la seva funci\u00f3 obstativa, per a impedir el registre o \u00fas de marques similars, ser\u00e0 m\u00e9s eficient.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<strong>Autora<\/strong>: <a href=\"https:\/\/curell.com\/ca\/equipo\/merce-hernandez-gazquez\/\">Merc\u00e8 Hern\u00e1ndez<\/a><\/span>, Advocada.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>De vegades, quan un client ens encarrega una sol\u00b7licitud de registre de marca, ens presenta un signe que, encara que pot ser molt atractiu en termes de m\u00e0rqueting, gaudeix d&#8217;un car\u00e0cter distintiu feble.
