On January 14, 2022, the draft reform to the Organic Law 6\/1985, of 1st July, on the Judiciary, for Commercial Courts (LOPJ) was published.<\/p>\n
The proposed amendment has a particular impact on our field, as it affects Articles 74.1 and 82.2. 3 LOPJ. In fact, the Sections specialized in Commercial Law of the Provincial Courts shall be responsible for the appeals lodged against the decisions that end the administrative procedures before the Spanish Patent and Trademark Office in intellectual property matters.<\/p>\n
Consequently, the High Courts of Justice shall no longer be responsible for IP cases in contentious-administrative proceedings.<\/p>\n
