{"id":3388,"date":"2020-11-26T21:18:21","date_gmt":"2020-11-26T21:18:21","guid":{"rendered":"https:\/\/curell.com\/?p=3388"},"modified":"2022-10-27T10:24:56","modified_gmt":"2022-10-27T10:24:56","slug":"banksy-who-once-said-that-copyright-is-for-losers-loses-in-the-eu-his-figurative-mark-for-the-flower-thrower-filed-in-bad-faith","status":"publish","type":"post","link":"https:\/\/curell.com\/en\/banksy-who-once-said-that-copyright-is-for-losers-loses-in-the-eu-his-figurative-mark-for-the-flower-thrower-filed-in-bad-faith\/","title":{"rendered":"Banksy, who once said that \u201cCopyright is for losers\u201d, loses in the EU his figurative mark for \u201cThe flower thrower\u201d filed in bad faith."},"content":{"rendered":"<p><sub><em>In September, the EUIPO\u2019s Cancellation Division upheld the\u00a0<\/em><\/sub><sub><em>application for invalidity filed against the trademark registration for the iconic stencil \u201cThe flower thrower\u201d\u00a0<\/em><\/sub><sub><em>because it considers that it was filed in bad faith.<\/em><\/sub><\/p>\n<p><a href=\"https:\/\/curellsunol.com\/wp-content\/uploads\/2020\/11\/ARTICLE-2-SOC-Imagen1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-12340\" src=\"https:\/\/curellsunol.com\/wp-content\/uploads\/2020\/11\/ARTICLE-2-SOC-Imagen1.jpg\" alt=\"\" width=\"162\" height=\"177\" \/><\/a><\/p>\n<p>In February 2014, the popular and anonymous street artist Banksy filed, through the company Pest Control Office Limited who acts as his legal representative in view of keeping the artist\u2019s identity hidden, the European Union trademark No. 12575155\u00a0 \u201cthe flower thrower\u201d.<\/p>\n<p>In March 2019, Full Colour Black Limited filed an application for invalidity of this trademark under article 59(1)(b) bath faith in filling and 59(1)(a) in connection with articles 7(1)(b) and (c) absolute grounds for refusal of the European Union Trademark Regulation.<\/p>\n<p>There is a say which is: Loose lips sink ships, and it is precisely Banksy\u2019s several statements that pushed in part the bad faith resolution passed by the EUIPO.<\/p>\n<p>Banksy declared in 2006 that \u201ccopyright is for losers\u201d and on many occasions the artist has encouraged people to copy, reproduce or modify his artworks for fun, for academic purposes or for social activism.<\/p>\n<p>Immediately after the application for invalidity, Banksy opened a shop that the public could not access, and later stated that the only purpose was to circumvent trademark law (all in all, to avoid a declaration of invalidity for non-use of his trademark registration).<\/p>\n<p>The evidence submitted by the plaintiff conveys for the Cancellation Division that, at the time the trademark application was filed, Banksy had no intention to use the trademark with its specific functions that is showing the commercial origin of some products or services.<\/p>\n<p>The Cancellation Division concludes that Banksy sought to obtain exclusive rights unlimitedly over the time for the sign\u00a0<a href=\"https:\/\/curellsunol.com\/wp-content\/uploads\/2020\/11\/ARTICLE-2-SOC-Imagen2.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-12343\" src=\"https:\/\/curellsunol.com\/wp-content\/uploads\/2020\/11\/ARTICLE-2-SOC-Imagen2.png\" alt=\"\" width=\"69\" height=\"47\" \/><\/a>,which could not be obtained under copyright law, and that this is not the function of a trademark.
